The terms that govern our work.

Read these carefully — they set out what you can expect from us and what we expect from you.

§ 01

About these terms.

These terms govern your use of capitaliscommercial.co.uk and any mortgage or commercial finance brokerage service provided by Capitalis Commercial Funding (“Capitalis”, “we”, “our”, “us”).

By using this site or instructing us to act on your behalf, you agree to be bound by these terms. If you do not agree, please do not use the site or our services.

§ 02

Our service.

Capitalis is an independent UK brokerage arranging bridging, commercial, development, buy-to-let and second-charge finance. We are not a lender. We work with a panel of regulated lenders and private finance providers and do not offer advice on products outside our panel.

We do not provide tax, legal or financial-planning advice. You should obtain independent professional advice where appropriate before completing any property or finance transaction.

§ 03

Eligibility.

Our services are intended for UK residents and UK-incorporated entities aged 18 or over. By engaging us you confirm you have legal capacity to enter into a finance agreement and that information you provide is accurate and complete.

§ 04

Fees.

Where a fee is payable for our service, the amount, payment trigger and refund policy will be confirmed in writing in your client agreement before any work commences. We may also receive commission from lenders; the basis of any commission will be disclosed in your suitability documentation.

§ 05

Your obligations.

You agree to:

  • 01Provide accurate, complete and up-to-date information about your circumstances and the property.
  • 02Notify us promptly of any material change to your circumstances during the application process.
  • 03Cooperate with reasonable requests for documentation required to verify identity and source of funds.
  • 04Use this site lawfully and not interfere with its security or availability.
§ 06

Intellectual property.

All content on this site — including text, graphics, logos, branding and imagery — is owned by or licensed to Capitalis and protected by UK and international copyright laws. You may view and download material for personal, non-commercial use only.

§ 07

Risk warning.

Your property may be repossessed if you do not keep up repayments on your mortgage.

Property values may go down as well as up. Past performance is not a guide to future performance. Lending is subject to status and affordability — credit decisions are made by the lender, not by us.

§ 08

Liability.

To the extent permitted by law, Capitalis is not liable for any indirect, consequential or special losses arising from your use of this site or our services. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

Our regulatory liability is governed by the rules of the Financial Conduct Authority and our network arrangement; nothing in these terms removes any statutory rights you may have as a consumer.

§ 09

Complaints.

If you are unhappy with any aspect of our service, please contact us at tam.ambia@capitaliscommercial.co.uk. If we cannot resolve your complaint, you may be entitled to refer it to the Financial Ombudsman Service (financial-ombudsman.org.uk).

§ 10

Governing law.

These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms.

We may update these terms from time to time. The version date below reflects the most recent revision. Continued use of the site after a revision constitutes acceptance of the updated terms.
